1. Description of Service

PackByte.app is a web-based food logistics planning tool for backcountry travel. The Service uses a foundational AI model to generate personalized meal plans from a curated catalog of verified trail foods based on user-provided trip parameters and dietary preferences.

PackByte.app is a planning tool, not a dietitian. The Service provides food logistics planning for wilderness travel and general wellness information. It does not provide medical nutrition therapy, dietetic advice, or treatment for any disease or medical condition. PackByte.app operates within the non-medical nutrition exemption of Maryland Health Occupations Article Section 5-103.

2. Eligibility

The Service is available only to individuals who are at least 18 years of age and who can form legally binding contracts under applicable law. By using the Service, you represent that you meet these requirements.

3. Account Registration and Access

3.1 Account Creation

To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3.2 Trail Pass

Access to meal plan generation requires the purchase of a trail pass. A trail pass grants you a defined period of unlimited meal plan generation from the date of activation. Trail pass terms (duration, pricing) are displayed at the time of purchase. Trail passes are non-transferable.

3.3 Promo Codes

We may issue promotional codes that grant complimentary trail pass access. Promo codes are subject to their own terms (duration, expiration) as specified at the time of redemption. Promo codes may not be sold, traded, or combined unless explicitly authorized.

4. Payment and Refunds

4.1 Payment Processing

All payments are processed by our third-party payment processor. By purchasing a trail pass, you agree to their terms of service and authorize them to charge your selected payment method. We do not store your payment card details on our servers.

4.2 Pricing

Prices are displayed in U.S. dollars at the time of purchase. We reserve the right to change pricing at any time, but price changes will not affect trail passes that have already been purchased.

4.3 Refund Policy

We offer a money-back guarantee on trail passes. If you are not satisfied with the Service, you may request a full refund by contacting us at [email protected] before your trail pass expires. Refunds are processed through Stripe to the original payment method.

5. Meal Plan Limitations

5.1 How Meal Plans Are Generated

PackByte.app uses AI to generate personalized meal plans. All items in your plan are sourced from a curated catalog of verified trail foods - the AI selects from this catalog based on your trip parameters and dietary preferences. Meal plans do not include items outside this catalog.

5.2 Catalog and Data Limitations

You acknowledge and agree that:

• Meal plans are sourced from our catalog, which we maintain with verified allergen and nutritional data, but catalog data may not be error-free or current. Manufacturers may change formulations, ingredients, or labeling at any time.
• You are solely responsible for verifying all ingredient labels, allergen information, and nutritional content against your specific needs before purchasing or consuming any food item.
• Calorie estimates are approximations based on formulas and catalog data. Actual caloric needs vary based on individual metabolism, conditions, and activity.
• The Service does not account for interactions between foods, medications, or medical conditions.

6. Allergen and Dietary Safety

PackByte.app employs a multi-layered safety architecture designed to reduce the risk of allergen and dietary violations in generated meal plans. This architecture includes catalog-level allergen data verification, pre-generation filtering, post-generation validation, and automated repair of detected violations.

Despite these measures, you acknowledge and agree that:

• No automated system can guarantee the complete absence of allergens or dietary violations in meal plan output.
• Allergen data is sourced from manufacturer-published information and cataloged in “contains” and “may contain” fields. We cannot guarantee the accuracy, completeness, or currency of manufacturer-provided allergen information.
• You must always verify ingredient labels against your specific allergies before purchasing or consuming any food item recommended by the Service.
• If you have severe or life-threatening food allergies, you should consult with a healthcare professional before relying on any meal planning tool, including PackByte.app.

The following allergen warning appears on every meal plan generated by the Service:

“Meals are selected from a curated catalog of verified trail foods. Always confirm ingredient labels against your specific allergies before the trip.”

7. Wilderness and Nutrition Disclaimers

You expressly acknowledge and agree to the following:

• Backcountry travel involves inherent risks including but not limited to inadequate nutrition, environmental hazards, wildlife encounters, and medical emergencies. The Service does not replace proper trip preparation, wilderness training, or professional guidance.
• The Service provides calorie estimates and food weight calculations as general planning aids. These are approximations and may not reflect your actual nutritional needs in the field.
• Any weight loss, weight gain, nutritional deficiency, or adverse health outcome that occurs during or after a trip planned using the Service is solely your responsibility.
• You should consult a qualified healthcare professional or registered dietitian for medical dietary needs, eating disorders, or any condition requiring medical nutrition therapy.
• Shelf stability, food quality, and weight estimates provided by the Service are approximations. You are responsible for verifying these against actual product specifications and conditions.

YOUR USE OF ANY MEAL PLAN GENERATED BY THE SERVICE IS AT YOUR OWN RISK.

8. Third-Party Links

Meal plans generated by the Service may include purchase links to third-party retailers (such as Amazon or brand-direct stores) for your convenience. PackByte.app currently earns no commission on these links.

Product selection is based solely on your calorie targets, dietary restrictions, allergen profile, and catalog data.

We make no warranty on the quality, availability, pricing, or safety of any third-party product or retailer. You are responsible for evaluating third-party products and performing your own due diligence before making any purchase.

9. Intellectual Property

9.1 PackByte Intellectual Property

The Service and its content, including text, graphics, logos, the PackByte.app name and brand, software code, catalog data, and the underlying AI prompt architecture, are owned by SkyeStaq LLC and are protected by intellectual property laws.

9.2 Personal Use License

You may use meal plans generated by the Service for your personal, non-commercial use. You may not reproduce, distribute, or commercially exploit the Service, its content, or its generated output without our prior written permission.

9.3 Third-Party Trademarks and Attribution

Product names, logos, and trademarks referenced in the Service are property of their respective owners. PackByte is not affiliated with, endorsed by, or sponsored by any of the brands referenced in its catalog. Nutrition and ingredient data is sourced from manufacturer-published information and is subject to change. Always verify against current product labeling.

10. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any systems, networks, or data connected to the Service.
• Use automated means (bots, scrapers, or similar tools) to access the Service or extract data from it.
• Interfere with or disrupt the operation, security, or performance of the Service.
• Use the Service to provide commercial meal planning or dietetic services to others.
• Misrepresent your identity, allergens, or dietary restrictions in a way intended to test, exploit, or compromise the safety architecture of the Service.
• Generate meal plans at a volume or rate inconsistent with personal trip planning use, or use the Service in any manner that appears automated, scripted, or designed to circumvent usage controls.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SKYESTAQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, error-free, or secure.
• Meal plans will be nutritionally complete, appropriate for your medical conditions, or free from allergen contamination.
• Calorie calculations, food weights, or nutritional estimates will be accurate.
• Catalog data, including allergen information, will be current or error-free.
• Third-party products linked in meal plans will be available, accurately described, or safe for your use.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SKYESTAQ AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, PERSONAL INJURY, ALLERGIC REACTIONS, NUTRITIONAL DEFICIENCY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE TRAIL PASS THAT GAVE RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless SkyeStaq and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• Your violation of this Agreement.
• Your reliance on any meal plan, calorie estimate, or food recommendation generated by the Service.
• Any allergic reaction, adverse health event, or injury resulting from food purchased or consumed based on the Service's output.
• Your violation of any rights of another person or entity.

14. Assumption of Risk

By using the Service to plan food for backcountry travel, you expressly assume all risks associated with:

• Wilderness travel, including but not limited to inadequate nutrition, dehydration, environmental hazards, and medical emergencies.
• Reliance on AI-generated meal plans that may contain errors or omissions.
• Consuming food products that may have been reformulated, mislabeled, or recalled by their manufacturers after being added to the PackByte.app catalog.
• Errors in calorie calculations, weight estimates, or nutritional data.

You acknowledge that you are responsible for exercising your own judgment and performing your own due diligence when preparing for backcountry travel.

15. Conservation Contribution

A portion of each trail pass purchase may be donated to a conservation organization. Details of the recipient organization and donation amount, if applicable, will be displayed at the time of purchase and on your receipt. Conservation donations are made by SkyeStaq and are not tax-deductible by the purchaser.

16. Third-Party Services and Links

The Service integrates with and may link to third-party services including our payment processor, database provider, AI model provider, and affiliate retailers. We do not control these third parties and are not responsible for their content, products, services, or privacy practices. Your use of third-party services is subject to their own terms and policies.

17. Account Termination

You may delete your account at any time by contacting us at [email protected]. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated this Agreement or for any other reason at our sole discretion. If we suspend or terminate your account due to automated or abusive usage in violation of Section 10, we will issue a pro-rata refund for any unexpired portion of your active trail pass.

Upon termination, your right to use the Service ceases immediately. Sections of this Agreement that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and assumption of risk) will survive.

18. Governing Law and Disputes

This Agreement is governed by the laws of the State of Maryland, without regard to its conflict of laws principles. Any disputes arising out of or relating to this Agreement or your use of the Service will be resolved in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.

19. Severability

If any provision of this Agreement is held to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

20. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and SkyeStaq regarding the Service and supersedes all prior agreements, communications, and understandings, whether electronic, oral, or written.
